Liability Waiver & Participation Agreement

Please read this agreement carefully. Enrollment in any NMPAC program constitutes acceptance of these terms by the student and/or parent or legal guardian.

1. Assumption of Risk

I understand and acknowledge that participation in dance, theater, music, and other performing arts activities involves physical activity and inherent risks, including but not limited to: muscle strains, sprains, falls, and other physical injuries. I voluntarily assume all risks associated with participation in any and all programs, classes, rehearsals, performances, and events offered by Northern Michigan Performing Arts Center (NMPAC).

2. Release of Liability

In consideration of my child's or my own participation in NMPAC programs, I hereby release, waive, discharge, and covenant not to sue Northern Michigan Performing Arts Center, its directors, officers, employees, volunteers, instructors, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the participant, whether caused by the negligence of NMPAC or otherwise, while participating in any NMPAC activity or while on or about the premises used by NMPAC.

3. Indemnification

I agree to indemnify and hold harmless Northern Michigan Performing Arts Center and its representatives from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation or my child's participation in NMPAC programs, whether caused by negligence or otherwise.

4. Medical Authorization

In the event of an injury or medical emergency, I authorize NMPAC staff to seek emergency medical treatment for the participant if I cannot be reached. I agree to be responsible for all costs associated with such medical treatment. I represent that the participant is in good physical health and has no medical conditions that would prevent safe participation in performing arts activities, unless disclosed in writing to NMPAC prior to participation.

5. Photo & Video Release

I grant Northern Michigan Performing Arts Center permission to photograph and/or video record the participant during classes, rehearsals, performances, and events. I authorize NMPAC to use such images and recordings for educational, promotional, and marketing purposes, including on the NMPAC website and social media channels, without compensation.

6. Code of Conduct Agreement

I have read and agree to abide by the NMPAC Code of Conduct. I understand that failure to comply with the Code of Conduct may result in suspension or dismissal from NMPAC programs without refund. I agree to support a positive, respectful, and safe environment for all students, families, faculty, and staff.

7. Severability

I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Michigan. If any portion of this agreement is held invalid, the balance of the agreement shall continue in full legal force and effect.

Acknowledgment

By enrolling in any Northern Michigan Performing Arts Center program — whether online, in person, or by submitting a registration form — the student and/or parent or legal guardian acknowledges that they have read, understood, and agree to all terms of this Liability Waiver and Participation Agreement.
